    I. GENERAL TERMS OF USE OF THE PORTAL

    1. Purpose

This document is intended to establish the General Terms of Use of the Internet Portal “cocampo.com” and any other portals owned by Cocampo Digital S.L. (hereinafter, Cocampo). Cocampo reserves the right to modify these General Terms of Use in order to adapt them to the applicable law in force at any given time. These General Terms of Use do not exclude the possibility that certain Portal Services, due to their particular characteristics, may also be subject to other specific conditions in addition to the General Terms of Use, as applicable. The use by the User of any of the Portal’s Services implies his or her adhesion to and express acceptance of all the General Terms of Use in the version published on the Portal at the time the User accesses it, as well as any Specific Terms that may apply.

    2. Portal Access and Use Conditions

2.1. Portal Access and Use Conditions

The use of any Portal Service confers upon the user the status of User of the Portal.

    2.2. Reservation

Cocampo reserves the right to fully or partially disseminate and edit the Advertiser’s advertisements on third-party portals, in advertising campaigns (whether its own or those of third-party companies with which the portal may reach agreements) to promote the Portal, as well as on other websites such as social networks or blogs. The Advertiser expressly accepts this condition for the maximum period allowed by law and within the broadest possible geographical scope.

    2.3. Registration Requirement

As a general rule, access to the Portal Services will not require the User to register on the Portal. However, the use of certain Services may be subject to prior registration. Such registration will be carried out in the manner expressly indicated in the respective Service or in the Specific Terms that apply thereto.

    2.4. Cost of Services

In general, the Services offered through the Portal are free of charge. However, the use of certain Portal Services is subject to payment under the terms and conditions determined in the corresponding Specific Terms.

2.5. Use of the Portal and its Services

The User acknowledges and agrees that the use of the content and/or services offered by the Portal is at the User’s sole risk and responsibility. The User undertakes to use the Portal and all of its content and Services in accordance with the law, morality, public order, these General Terms of Use, and any applicable Specific Terms. The User also undertakes to make proper use of the Portal’s services and content and not to use them for illicit or criminal activities, acts that infringe the rights of third parties, or acts that violate intellectual or industrial property laws, or any other applicable legal provisions. The User acknowledges and agrees that the Portal will send an automatic reply for each listing of interest in which the User properly contacts. In particular, the User agrees not to transmit, introduce, disseminate or make available to third parties any type of material or information (data, messages, drawings, sound and image files, photographs, software, etc.) that is contrary to the law, morality, public order, these General Terms of Use, or any applicable Specific Terms. By way of example and not limitation, the User undertakes not to:

    • Submit or distribute content or propaganda of a racist, xenophobic, pornographic nature, or content that promotes terrorism or violates human rights.
    • Introduce or distribute computer programs (such as viruses or malicious software) that may cause damage to the computer systems of the access provider, its suppliers, or other Internet users.
    • Disseminate, transmit or make available to third parties any information, element or content that violates fundamental rights and public liberties recognized constitutionally or in international treaties.
    • Disseminate, transmit or make available to third parties any information, element or content that constitutes illegal or unfair advertising.
    • Transmit unsolicited or unauthorized advertising, promotional materials, “junk mail,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in areas (such as designated commercial sections) that are exclusively intended for that purpose.
    • Introduce or disseminate any false, misleading or inaccurate information or content that could mislead the recipients.
    • Impersonate other Users by using their registration credentials to access the Portal’s services or content.
    • Disseminate, transmit or make available to third parties any information, element or content that violates the intellectual or industrial property rights, patents, trademarks or copyrights belonging to Cocampo or third parties.
    • Disseminate, transmit or make available to third parties any information, element or content that violates the confidentiality of communications or personal data protection laws.

    3. Intellectual and Industrial Property

The User acknowledges that all elements of the Portal and each of the Services provided through it — including the information and materials contained therein, the structure, selection, arrangement and presentation of its contents, and the computer programs used in connection with it — are protected by Cocampo’s or third parties’ intellectual and industrial property rights. Unless authorized by Cocampo or the relevant third-party rights holders, or unless legally permitted, the User may not reproduce, transform, modify, disassemble, decompile, perform reverse engineering, distribute, rent, lend, or make available to the public in any manner any of the elements referred to above. In particular, the use of the texts, images, advertisements and any other elements included on this website for their subsequent inclusion, in whole or in part, on websites not owned by Cocampo is strictly prohibited without Cocampo’s prior written authorization.

The User must use the materials, elements and information accessed through the Portal and each of the Services only for his or her own personal needs, and undertakes not to engage in any commercial exploitation, directly or indirectly, of the Services or the materials, elements and information obtained through them. The User shall refrain from removing the identifying marks of rights (such as intellectual or industrial property rights or any other rights) of Cocampo or third parties that appear on the Portal and in the various Services offered through it. Likewise, the User shall refrain from circumventing or manipulating any technical devices established by Cocampo or third parties (whether on the Portal, any of the Services, or in any materials, elements or information obtained through them) for the protection of rights.

By uploading photographs to the Portal, the User grants Cocampo, free of charge, the rights to exploit the intellectual property in them. Consequently, Cocampo may reproduce, transform (including but not limited to adding watermarks or other mechanisms that prevent unauthorized use by third parties), distribute and communicate these photographs to the public (including making them available to the public) by any exploitation method and using any format, support or medium for exploitation or communication. This assignment of rights is not subject to any temporal or territorial limitation: it is made worldwide and for the full legally permissible duration of the rights. Cocampo may exercise the exploitation rights of the photographs in any manner it deems most appropriate, and may even transfer or assign those rights, either exclusively or non-exclusively, to third parties on terms and conditions it considers suitable.

    4. Disclaimer of Warranties; Liability

4.1. Portal and Services Availability and Continuity

ocampo does not guarantee the availability, access, or uninterrupted operation of the Portal and its Services. Cocampo will not be liable, within the limits established by applicable law, for any damages or losses incurred by the User as a result of unavailability, access failures or interruptions of the Portal and its Services.

    4.2. Cocampo’s Content and Services

Cocampo will be solely and exclusively responsible for the Services it provides itself and for the content directly created by Cocampo and identified with its copyright. Such responsibility will be excluded in cases of force majeure or in cases where the User’s equipment is not configured properly to allow the correct use of the Internet services provided by Cocampo. In any event, Cocampo’s potential liability to the User for all claims will be limited to the amount of fees received directly by Cocampo from the User, and will exclude any liability for indirect damages or loss of profits.

    4.3. Third-Party Content and Services

Cocampo neither controls nor endorses any third-party contents, services, opinions, communications, data, files, products or any other type of information from third parties (whether legal entities or individuals) appearing on the Portal. Likewise, Cocampo does not guarantee the lawfulness, reliability, usefulness, truthfulness, accuracy, completeness or timeliness of third-party content, information or Services on the Portal. Cocampo shall not be liable, either directly or vicariously, for damages of any nature arising from the use or contracting of third-party content and Services on the Portal, nor for any lack of legality, reliability, usefulness, truthfulness, accuracy, completeness or timeliness thereof. By way of example and not limitation, Cocampo shall not be responsible for damages of any kind arising from:

    • The infringement of intellectual or industrial property rights and the defective performance or non-performance of contractual commitments undertaken by third parties.
    • Acts of unfair competition or illegal advertising.
    • The inadequacy or frustration of expectations regarding the Services and content of third parties.
    • Any defects or faults of any kind in the third-party Services and content provided through the Portal.

Cocampo does not exercise prior control, does not guarantee, and will not be liable — either directly or vicariously — for damages of any nature caused to the User as a result of the presence of viruses or other elements in the content or Services provided by third parties that may cause alterations in the User’s computer system, electronic documents, or files.

The foregoing disclaimers of liability shall apply unless and until Cocampo has actual knowledge that the activity or information stored by a third party is illegal or infringes the rights of a third party that could give rise to compensation, or unless Cocampo acts diligently, once it has such knowledge, to remove the data and content or disable access to them.

    4.4. User Conduct

Cocampo does not guarantee that the Portal’s Users will use the content and/or services in conformity with the law, morality, public order, these General Terms of Use, or any applicable Specific Terms. It also does not guarantee the truthfulness, accuracy, completeness or authenticity of data provided by Users. Cocampo shall not be liable, either directly or vicariously, for damages of any nature arising from the use of the Portal’s Services and content by Users or from the lack of truthfulness, accuracy or authenticity of data or information provided by Users, or from any impersonation of a third party by a User in any action through the Portal. By way of example and not limitation, Cocampo shall not be liable (directly or vicariously) for:

    • Contents, information, opinions and statements of any User or third party communicated or displayed through the Portal.
    • Damages caused to third parties resulting from a User’s use of the Portal’s services and content.
    • Damages caused by the untruthfulness, inaccuracy or incorrectness of the identity of Users and all information they provide or make accessible to other Users.
    • Damages resulting from any User’s infringement of the rights of another User or third parties, including copyrights, trademarks, patents, confidential information and any other intellectual or industrial property rights.

    5. Contracting with Third Parties through the Portal

The User acknowledges and agrees that any contractual or non-contractual relationship that the User may enter into with advertisers or third parties contacted via the Portal (including participation in contests, promotions, purchase or sale of goods or services) is understood to be carried out exclusively between the User and the advertiser and/or third party. Consequently, the User accepts that Cocampo has no responsibility for any damages of any nature resulting from the User’s negotiations, conversations and/or contractual or non-contractual relationships with advertisers or third parties (natural or legal persons) contacted through the Portal.

    6. Linking Devices and Search Tools

The Portal provides Users with technical linking devices and search tools that enable access to portals owned by third parties (links). The User acknowledges and agrees that the use of the services and content of the linked portals is at the User’s sole risk and responsibility, and exonerates Cocampo from any liability for the technical availability of the linked portals, or the quality, reliability, accuracy or truthfulness of the services, information, elements and/or content to which the User may access on the linked portals and the search directories included in the Portal. Cocampo shall not be liable, either directly or vicariously, for damages of any nature arising from:

    • The operation, unavailability, inaccessibility or lack of continuity of the linked portals and/or the search directories available.
    • The lack of maintenance and updating of the contents and services of the linked portals.
    • The lack of quality, inaccuracy, illegality or uselessness of the contents and services of the linked portals.
    • The aforementioned limitation of liability shall apply unless and until Cocampo has actual knowledge that the activity or information to which it refers is illegal or infringes the rights of a third party that could give rise to compensation, or unless it acts diligently, once it has such knowledge, to remove the data and content or disable access to them.

    7. Termination

Without prejudice to any liability for damages that may arise, Cocampo may immediately and without prior notice terminate and end its relationship with the User, interrupting the User’s access to the Portal or its Services, if it detects that the User is using the Portal or any of its Services in a manner contrary to applicable general or specific terms. The User shall be responsible for any damages of any kind that Cocampo may suffer, directly or indirectly, as a result of the User’s breach of any obligations arising from the applicable general or specific terms regarding the use of the Portal or any of its Services. Likewise, the User shall keep Cocampo indemnified against any sanctions, claims or lawsuits that may be brought by any third party, including public authorities, against Cocampo, its employees or agents, as a result of the violation of any third-party rights by the User through the use of the Portal or its services in a manner contrary to the applicable terms.

    8. Miscellaneous

    8.1. Modifications

Cocampo reserves the right to make any modifications it deems appropriate to the Portal, including the right to modify, remove or include new contents and/or services, as well as the manner in which they are presented or located.

    8.2. Minors

As a general rule, to use the Portal’s services, minors must have prior authorization from their parents, tutors or legal representatives, who will be responsible for all acts carried out through the Portal by minors under their care. In the Services where expressly indicated, access shall be restricted exclusively to persons over 18 years of age.

    9. Duration and Termination

The provision of the Portal’s services and/or content is of indefinite duration. Notwithstanding the foregoing, and pursuant to these General Terms of Use, Cocampo is authorized to terminate, suspend or unilaterally interrupt, at any time and without notice, the provision of the service, the Portal and/or any Services, without prejudice to any provisions to the contrary set forth in the corresponding Specific Terms.

II. PARTICULAR TERMS FOR THE CONTRACTING OF THE ADVERTISEMENTS SERVICE

    1. General Contracting Conditions

1.1. This document is intended to establish the General Contracting Conditions of the ADVERTISEMENTS Service (hereinafter, the Service) provided by Cocampo Digital S.L. (hereinafter, Cocampo), Tax ID B09811183, on the Internet Portal https://www.cocampo.com (hereinafter, the Portal).

    2. Service Description

2.1. The Advertisements Service may consist of the following modalities

2.1.1. Free Ad Access Service: Access and visualization of the ads published on the advertisement portal. This service is free of charge for website Users. To be able to publish ads, the User must register and provide the personal data required on the corresponding form.

2.1.2 Limited “Atlas” Service: Limited access to the "Atlas" service where navigation on the map is allowed up to a certain level of detail, but full visualization of all available properties is not permitted. This service is free of charge for website Users.

2.1.3. “Portal España” Publication Service: Publication of ads on the “Portal España” service. This service incurs the cost indicated on the website, unless there are specific promotions or offers duly published on Cocampo’s website or personally communicated to Users of the service.

2.1.4. “International Portal” Service: Allows the publication of ads on the portal outside of Spain (Portugal, France, Italy, etc.). This service incurs the cost indicated on the website, unless there are specific promotions or offers duly published on Cocampo’s website or personally communicated to Users of the service.

2.2. Cocampo reserves the right to disseminate, in whole or in part, the Advertiser’s ads on third-party portals, in advertising campaigns to promote the Portal, as well as on other websites such as social networks or blogs. The Advertiser accepts this condition. The User warrants that he is the sole holder of the rights granted to Cocampo under this clause, and that the use and exploitation thereof by Cocampo will not violate any intellectual property rights, image rights, or any other rights of third parties. The User agrees to indemnify and hold Cocampo harmless in the event of any infringement by the User of these representations and warranties.

    3. Service Modalities

The service for individual (private) advertisers is free with a limit of two (2) ads, whereas plans for real estate agents are free with an unlimited number of ads. The free plans will be offered for a limited time and under special circumstances. If a User does not find any active free plan, it means no such plan is currently available.

    4. Service Contracting Procedure

4.1. To publish ads that require contracting and/or payment, the User must subscribe to one of the current paid Plans announced on the website: Bronze Plan, Silver Plan, or Gold Plan. This service will incur the cost indicated on the website, unless there are specific promotions or offers duly published on Cocampo’s website or communicated personally to the Users of the service. The Advertiser must complete his or her registration (at which time the Advertiser’s data will be recorded) and fill in the publication details of the ad. All ads must undergo a prior validation process, which may take between 24 and 48 hours. However, Cocampo reserves the right to complete this validation after the ad has been published if needed.

The User may contract the services by following the procedure: register on the platform (mandatory), select the desired subscription plan, confirm acceptance of the terms and conditions, pay through Banco Santander’s virtual POS (via the Redsys system, using credit card or Bizum), and receive confirmation of the subscription by email. Prices include 21% VAT and may be paid in euros or other currencies accepted by the platform.

4.2. A registered Advertiser may post and renew ads simply by logging in. Once registered, each time the User accesses the ads section of the website, the User must sign in to interact with the site.

    5. Advertising Publication Rules

5.1. As a general rule, the publication of ads on the Portal is subject to the following rules:

    • Duplicate ads will not be published
    • Ads that contain contact information (phone numbers, emails, URLs, etc.) in the property description will not be published.
    • Ads that include photographs with watermarks from any other real estate portal, or logos or contact information (phones, emails, URLs, etc.) of the Advertiser, or any photograph unrelated to the advertised property or of insufficient quality, will not be published.
    • Ads with paid premium-rate contact phone numbers (e.g., 80x numbers) will not be published.
    • Ads concerning any product, service or information that may be contrary to the law, morality, public order, or the Portal’s editorial rules will not be published.

5.2. Cocampo reserves the right, if necessary, to reject or modify an ad so that it complies with the above rules.

    6. Limitation of Liability

6.1. The Advertiser acknowledges and agrees that Cocampo’s maximum liability to the Advertiser arising from the insertion of ads is as follows: If Cocampo fails to insert the ad on the agreed dates, or if the ad is not inserted in the agreed form and terms (whether due to technical reasons or any other cause), the maximum liability shall be limited to reinsert the ad later in a similar position. If that is not possible, Cocampo will contact the Advertiser to determine an alternative solution.

6.2. In no event will Cocampo be liable for any other type of damages, whether actual, indirect, or otherwise, nor for any loss of profits suffered by the Advertiser due to the late or incorrect publication or non-publication of any ad.

6.3. Cocampo will not be liable for delays, incorrect publication or failure to publish the ad that result from events or circumstances beyond its control, including, by way of example and not limitation, governmental actions, fire, flood, insurrection, earthquake, technical failure, riot, explosion, embargo, legal or illegal strikes, shortages of personnel or materials, transportation interruptions of any kind, labor delays, or any other circumstances beyond Cocampo’s control.

    7. Advertiser’s Representations, Warranties and Indemnities

7.1. The insertion of ads on the Portal is contingent upon the following representations and warranties made by the Advertiser.

7.2. The Advertiser has the right to publish the content of the ad, and doing so will not infringe any law or any third-party rights, including industrial or intellectual property rights. It is the Advertiser’s responsibility to obtain all necessary public or private authorizations and to pay all fees for the use of any industrial or intellectual property rights included in the ad. The Advertiser acknowledges that Cocampo agreed to place the ad based on this representation and warranty.

7.3. With respect to any images, audio or video included in the ads, the Advertiser is solely responsible for their content, and they must not violate any laws or the established legal framework, nor contain insults, slurs, foul language, or any form of discrimination. The Advertiser must also comply with the previous paragraph.

7.4. The Advertiser, as well as the ad, its content, and any Advertiser materials that Portal Users can access through the ad, comply with current advertising regulations (including those applicable to electronic and online advertising) and all other applicable laws, in particular those related to telecommunications, consumer and user protection, the rights to honor, privacy and image, and the protection of minors and children.

7.5. The inclusion of the ad on the Portal or any websites does not constitute a breach or violation of any legal and/or contractual obligation assumed by the Advertiser with third parties.

7.6. The Advertiser will be solely responsible, with respect to Portal Users and third parties, for the text and information contained in the ad. Thus, by way of example and not limitation, Cocampo shall not be liable — directly, indirectly or vicariously — for damages of any kind that Portal Users and/or third parties may suffer due to the untruthfulness, inaccuracy, or illegality of data or information contained in the ad.

7.7. The Advertiser acknowledges and agrees that any contractual or non-contractual relationship that the Advertiser may enter into with Portal Users or third parties contacted through the Portal is understood to be carried out exclusively between the Advertiser and the Portal User and/or third party. Consequently, the Advertiser agrees that Cocampo has no responsibility — direct, indirect or vicarious — for damages of any nature caused to Portal Users and/or third parties by negotiations, conversations or contractual or non-contractual relationships they enter into with the Advertiser.

7.8. In any event, the Advertiser agrees to indemnify Cocampo, immediately upon request, for all expenses, costs, damages and losses of any kind (including attorneys’ and legal fees, even if their involvement is not mandatory) incurred by Cocampo as a result of any claim, actual or imminent, of any kind related to the publication or dissemination of the ad or its content. This includes claims based on infringement of industrial or intellectual property rights, defamation, libel, breach of confidentiality, disclosure of secrets, violation of any legal or regulatory duty, and/or unlawful, false or misleading advertising.

    8. Cocampo’s Right to Reject Ads

8.1. Cocampo is not obligated to review the content of any ad in advance, and any review or approval by Cocampo shall not be construed as acceptance that the ad complies with these General Contracting Conditions.

8.2. Cocampo reserves the right, at any time and at its discretion, to:

    • Reject any ad.
    • Remove any ad from Cocampo’s records or from any page.

    9. Common Payment Terms for Subscription Services

Cocampo allows the free publication of ads. However, it also offers subscription plans with additional features and benefits for advertisers. If a User contracts one of these plans, the subscription will remain active until the User cancels it. During the contracting process, personal data necessary for service management and invoice issuance may be requested.

    Subscription Plans and Payment Methods

The subscription fee will be charged using the payment method selected by the User at the time of contracting, which will remain visible at all times in the User’s profile. Billing cycles are communicated before contracting. The specific billing date may be changed due to reasons beyond Cocampo’s control, including incidents attributable to the User or the payment service providers used by Cocampo.

    Payment Methods

When contracting a subscription plan, the User must select one of the payment methods available in the subscription form. This method will be used for future payments associated with the service, unless the User expressly changes it from his or her profile. If Cocampo cannot process the charge for a billing cycle, the User will be notified with sufficient advance time to update their payment details and settle the outstanding amount. If, after the indicated period, the User has not paid the due amounts, Cocampo will cancel the subscription.

    Cancellation of Subscription

The User may cancel their subscription at any time without giving any reason. Cancellation will take effect at the end of the current billing period, so the User will retain access to the subscribed service until that date, with no right to a refund for the unused portion. To cancel, the User must log into their profile on the platform, go to the “Subscription” section and select the cancellation option. Once completed, Cocampo will send the User an email confirmation detailing the effective cancellation date and the last applicable billing period.

Payments made are non-refundable. Cocampo will not provide refunds or compensation for unused features or for cancellations made before the end of the billing cycle.

    Modifications to Plans or Prices

Cocampo may modify at any time the conditions, features or prices of its subscription plans. Such modifications shall not take effect until 30 days have elapsed since notification to the User. If the User does not wish to accept the new conditions, they may cancel their subscription before the changes come into effect.

    Right of Withdrawal

In accordance with Article 103(m) of the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU), the User is informed that they will automatically lose their right of withdrawal at the moment the provision of the contracted service begins. Contracting and, if applicable, activating the service implies the immediate commencement of execution, so the User expressly acknowledges and agrees that upon such commencement, they forfeit the right of withdrawal. However, if afterwards the User wishes to cancel the subscription, they may do so in accordance with these special conditions. Generally, such cancellation does not entail any refund, as payments are non-refundable. Nevertheless, Cocampo may offer partial refunds in specific circumstances (such as cancellations within a certain timeframe or in exceptional situations), which will be evaluated and determined by Cocampo on a case-by-case basis.

    1.6. Data Protection
